Pursuant to Article IX of the United Mine Workers of America (“UMWA’) 1950 Benefit Plan and Trust, 并根据美国劳工部授予的豁免授权, the Trustees have reviewed the facts and circumstances of this dispute concerning the level of 健康 benefits coverage for an 员工 under the terms of the 雇主 Benefit Plan. 他们在此就此事发表意见.

尽管有上述规定, in the event an 员工 accepts employment during a period of continued coverage under paragraph (a), 健康, life and accidental death and dismemberment coverage will terminate as of the date of such employment. 尽管申诉人已被停职,意图解除职务, the arbitrator’s final order to reinstate the Complainant nullifies any effect of the disciplinary action with respect to the Respondent’s obligation to provide benefits coverage. 因此, the issue in this case must be decided based on the Respondent’s obligation to provide benefits coverage to a laid-off 员工.

(1) (a) of the 雇主 Benefit Plan provides continued 健康 benefits coverage for a laid-off 员工 based upon the number of hours worked for the 雇主 during the 24 consecutive calendar month period immediately prior to the 员工’s last day worked. 尽管有上述规定,第三条第D款. Although the Complainant has stated that his later employment was not permanent and that he did not receive 健康 benefits coverage, the notification provisions of the Plan do not distinguish between the acceptance of “temporary” or “part-time” and full-time employment. 因此, 在没有适当通知的情况下, 申诉人的健康福利已于4月30日适当终止, 1985, 投诉人接受其他工作的日期. 相应的, the Respondent is not responsible for the provision of additional 健康 benefits coverage for the Complainant and his eligible dependents.
