Pursuant to Article IX of the United Mine Workers of America (“UMWA”) 1950 Benefit Plan and Trust, and under the authority of an exemption granted by the United States Department of Labor, the Trustees have reviewed the facts and circumstances of this dispute concerning 健康 benefits coverage under the terms 雇主福利计划的成员.

1.During any period for which an employee is granted an approved leave of absence for the purpose of accepting temporary employment with the United Mine Workers of America (UMWA) such 员工 shall be

有资格继续健康, life and accidental death and dismemberment insurance coverage for a period not to exceed 120 calendar days within any 12-month period.

2.During any period for which an 员工 is granted an approved leave of absence for any other reason, 该雇员的健康资格, life and accidental death and dismemberment insurance coverage shall be terminated as of the day last worked and shall not be reinstated until the 员工 returns to active work except as provided in paragraph 3 below.

3.如果员工在批准的休假中被置于解雇状态, or would have been placed on lay-off status had the 员工 been actively at work, 健康, life and accidental death and dismemberment coverage shall be reinstated as of the effective date of lay-off. In no event shall coverage under this paragraph continue beyond the balance of the month plus 12 months from the effective date of lay-off. An 员工 who returns to work after having been on leave of absence shall not have the period for which such 员工 was on leave of absence included in the 24-calendar-month period as used in paragraph (a) for determining eligibility for continuation of coverage.
