The Trustees have reviewed the facts and circumstances of this dispute concerning the provision of benefits under the terms of the 雇主 福利计划.

The Complainants were employed in classified positions with the Respondent until they were laid off. The Respondent was signatory to the National Bituminous Coal Wage Agreement (“Wage Agreement”) of 1988 which expired on February 1, 1993.

The Respondent was struck by the United Mine Workers of America (“UMWA”) on February 2, 1993, 直到3月2日, 1993. Article I (1), (2) and (4) of the 1988 and 1993 雇主 福利计划s provide:

6月3日, 1993, the Respondent was struck for a second time by the UMWA and the Complainants’ health benefits coverage was suspended. In the event of an economic strike following the expiration of the Wage Agreement, 第三条D. (2) of the 雇主 福利计划 requires an 雇主 to advance the insurance premiums for the Employee’s health, 视力保健, 人寿及意外死亡及肢解保险给付. 第三条D. (2)进一步说明如果罢工持续超过30天, 工会或该等雇员可选择自行支付保费. 被申请人符合第三条第D款的要求. (2) when it advanced the Complainants’ insurance premiums during the first strike period in February 1993.

12月16日, 1993, the Respondent signed the Wage Agreement of 1993 and reinstated the Complainants’ health benefits coverage. 根据第二条A款. (2)根据1993年工资协议修订的雇主福利计划, the Complainants’ eligibility for continuation of coverage is continued under the 1993 雇主 福利计划 for the period for which the Complainants would have been eligible under the prior (1988) Plan. 因此, the Complainants’ eligibility for continuation of coverage continued under the 1993 雇主 福利计划 到5月3日1, 1994.

The Complainants contend that their coverage should be extended beyond May 31, 1994, 以抵消罢工期间暂停发放福利的费用. 第三条D.
